Terms of Service

This is a translation provided for convenience. The legally binding version is the Russian one; in case of any discrepancy, the Russian version prevails.

These Terms of Service (hereinafter — the "Terms") govern the relationship between the administration of the Compressify service (hereinafter — the "Service", the "Administration", "we") and any person using the Service (hereinafter — the "User", "you").

The Administration's details are set out in the "Details" section at the end of the document and in the Public Offer.

1. Definitions

• Service (Compressify) — the website Compressify.pro and related software intended for processing (compressing, converting) the User's files.
• Plan (Tariff) — a set of access conditions to the Service (limits, amount of credits, restrictions on file size and number). The list and conditions of plans are described in the "Subscription Terms".
• Credits — internal accounting units consumed when processing files. Credits are not money, electronic money or a means of payment, and are not exchangeable for money.
• Paid credit reset (Reset) — an independent one-time paid service that restores the current credit balance to the full credit limit of the plan in effect. Detailed conditions are set out in the “Subscription Terms”.
• Account — the User's account created upon registration.

2. Acceptance of the Terms

2.1. By using the Service in any way (opening the site, uploading files, registering or paying for a plan), you confirm that you fully and unconditionally agree to these Terms, the Privacy Policy, the Offer and the Subscription Terms.

2.2. If you do not agree with any of the conditions, stop using the Service.

2.3. The Terms apply to both registered and unregistered Users.

2.4. By using the Service, the User confirms that they are at least 18 years old. The Service is not intended for minors; processing of minors' personal data is not envisaged.

3. Description of the Service

3.1. The Service provides the ability to automatically process files (compression, conversion and other operations) through a web interface.

3.2. The Service operates on a plan model. A free plan, paid subscriptions and one-time passes (pass) are available; paid credit Resets are also available for certain active paid plans. The composition, limits and cost of plans, as well as the Reset conditions, are set out in the “Subscription Terms”.

3.3. Labels such as "Popular", "Best value" and similar are purely marketing, do not constitute an offer of special content and do not give rise to any additional obligations of the Administration.

3.4. With respect to the free plan and unregistered Users, the Administration may unilaterally and without prior notice change the conditions of access (limits, amount of credits, available features, plan characteristics), as well as temporarily restrict or fully prohibit use of the Service for a certain period. Free access is provided "as is" and is not guaranteed.

4. Registration and Account

4.1. Access to some features requires registration with an e-mail address.

4.2. The User undertakes to ensure the confidentiality and security of their credentials (login, password and other access data), not to transfer access to the Account to third parties, and is responsible for all actions performed under their Account.

4.3. As part of performing the contract, the Administration sends the User transactional and technical notifications (about login, payment, subscription status, changes to terms, etc.) to the e-mail address provided at registration. Such notifications are not a marketing mailing and are sent by virtue of the concluded contract.

4.4. The Administration is not responsible for the actions of third parties who gained access to the Account through the User's fault (due to disclosure of credentials, careless storage, etc.).

5. Collection of technical data

5.1. When using the Service (including by unregistered Users), technical data is processed automatically, including the IP address and browser information (User-Agent).

5.2. The composition, purposes and retention periods of data are described in the Privacy Policy.

6. Rules of use

6.1. The User undertakes not to use the Service to process files containing unlawful information, malware, or materials that infringe the rights of third parties or the legislation of the Russian Federation.

6.2. The User is solely and fully responsible for the content and legality of uploaded files and for having the rights to process them.

6.3. The User is prohibited from uploading files containing personal data (of the User or of third parties). The User is responsible for breaching this prohibition.

6.4. The Administration does not store uploaded files and does not transfer them to third parties, except for transferring them for direct processing on the infrastructure of a third-party provider — Yandex Cloud Serverless Containers (the servers do not belong to the Administration). See the Privacy Policy for details.

6.5. It is prohibited to create excessive load on the Service, use automated means of mass requests, circumvent plan limits and the credit system. On the free plan it is prohibited to use software that blocks or replaces the display of advertising (including AdBlock and similar extensions): the display of advertising is a condition of providing free access to the Service.

6.6. The User is prohibited from exploiting vulnerabilities of the Service, attempting unauthorised access (hacking) to the Service, its infrastructure, Accounts or other Users' data, and from facilitating such actions by third parties. If such actions are detected, the User's Account is blocked.

6.7. In case of breach of these rules, the Administration may restrict or terminate the User's access to the Service.

6.8. The User must comply with these Terms and all other legal documents of the Site (the Privacy Policy, the Public Offer, the Subscription Terms).

6.9. In case of breach of the rules, the User's Account may be blocked (access restricted or terminated). For questions about blocking and other matters, the User may contact the Administration via the technical support window at the bottom of the site (footer) or by the support e-mail address.

7. Rights and obligations of the Administration

7.1. The Administration ensures the operability of the Service, except during maintenance work.

7.2. Maintenance work may be carried out at any time without prior warning.

7.3. The Administration may change the functionality, interface and structure of the Service without prior notice.

7.4. The Administration may temporarily restrict access to the Service if the User breaches these Terms.

7.5. The Administration is not responsible for failures and interruptions of the Service caused by third-party services (payment aggregators, hosting, communication channels, etc.).

8. No guarantee of processing result

8.1. The Administration does not guarantee that any file will be successfully processed (compressed, converted). The result depends on the format, content, size of the file and other factors.

8.2. The degree of compression and reduction in file size are not guaranteed. In some cases the resulting file may not decrease in size, or processing may fail with an error.

8.3. The Service is provided "as is"; uninterrupted operation and the complete absence of errors are not guaranteed. The Administration is not responsible for the suitability of the processing result for the User's purposes.

9. Intellectual property

9.1. All rights to the Service, its design, source code and elements belong to the Administration.

9.2. Files uploaded by the User remain the property of the User; the Administration acquires no rights to them, except for technical processing to the extent necessary to provide the service.

10. Limitation of liability

10.1. The Administration is not liable for direct and indirect losses arising in connection with the use or inability to use the Service, nor for the loss of the User's data, except in cases expressly provided for by the legislation of the Russian Federation.

10.2. The User is solely responsible for backing up their information and keeping the originals of files. The Administration is not responsible for the safety of uploaded or processed files.

11. Plans and changes to conditions

11.1. Use of the Service is carried out on the conditions of the chosen plan.

11.2. When plans change, the new conditions take effect upon their publication on the Site. For active paid Subscriptions, the prior-notice procedure provided for by the Public Offer and the Subscription Terms applies.

12. Changes to legal documents

12.1. Consent to the legal documents of the Site takes effect from the moment of starting to use the Service.

12.2. The Administration may amend these Terms and other legal documents of the Site; the updated version is published on the Site and takes effect upon publication.

12.3. Continued use of the Service after a change means the User's consent to the new version.
